Stop Portland Waste Incinerator is hugely disappointed that we lost our recent legal battle challenging the government's decision to award planning permission to the Powerfuel Portland waste incinerator.

We argued that the government's decision to overturn Dorset Council's rejection of the plans failed to acknowledge the council's waste strategy. We were very disappointed that the Judge was unable to see that the planned waste incinerator does not comply with our county’s waste plan and ruled in favour of the Government.

We do have one final chance left on the legal challenge side of things and that is to try and get our case heard at the Court of Appeal, which instead of being heard by only one person, the decision is made by three Judges. Your help raising funds to pay for legal representation is needed.

We are re-launching our fund-raising campaign to fund our legal team, because from all that was said to me by everyone I spoke to before the Statutory Review, I believe that the majority of those who are opposed to the incinerator would like us to fight to the bitter end and therefore I have asked our legal team to request permission to appeal at the Court of Appeal.

Once again this is a legal battle not a planning battle and we need a legal team to help us to have any chance of getting a High Court Judge to quash the Government’s decision.

We therefore, once again, need to raise funds to engage a legal team, consisting of a lawyer, barrister and KC to present the legal grounds for challenging the decision, in order to ensure our appeal gets heard in the Courts of Appeal and in an attempt to quash the Government's decision to grant planning permission.
